In the Gyanvapi Masjid case, the Supreme Court shifted the civil complaint filed by Hindu devotees from the civil judge (senior division) to the Varanasi district judge. Given the intricacies and sensitivity of the subject, the supreme court decided that the case should be handled by a senior judicial official. The bench, which included Justices DY Chandrachud, Surya Kant, and PS Narasimha, stated on May 20 that it was not passing any judgement on the civil judge (senior division) who had previously dealt with the case.

The apex court said that its earlier interim order of May 17 directing protection of the area where “shivling” is said to be found and allowing Muslims to offer “namaz” in mosque premises shall remain in operation till the maintainability of the suit is decided by the district judge and thereafter for eight weeks to allow the aggrieved parties to approach the higher court.

“If anybody creates impediment in the exercise by the court commissioners, the district administration must register a first information report (FIR) and take strict action. In any condition, the court commissioner’s exercise shall not stop,” stated the court order, seeking the commission’s report on May 17.

The Gyanvapi Masjid case traces back to 1991 when local priests filed a suit in the Varanasi Civil Court seeking permission to worship in the Gyanvapi Mosque Complex claiming that it was built on the demolished portion of the Kashi Vishwanath Temple by Aurangzeb.
